Privacy Policy

Notice at collection (summary)

TREC Trucking LLC collects the personal and business information you provide when you register as an owner-operator or contact us — including identifiers, contact details, authority numbers, banking information for payment, and government identifiers on your W-9. We use it to onboard you, pay you, meet legal obligations, and communicate with you. We do NOT sell your personal data, do NOT use it for targeted advertising, and do NOT engage in profiling that produces legal or similarly significant effects. Texas residents have specific rights under the TDPSA — see below.

Introduction

TREC Trucking LLC ("we", "our", "us") operates trectrucking.com and provides trucking dispatch and subcontractor onboarding services. This Privacy Policy explains what personal data we collect, how we use it, who we share it with, how long we keep it, and the rights available to Texas residents under the Texas Data Privacy and Security Act (TDPSA, Tex. Bus. & Com. Code ch. 541), which took effect July 1, 2024.

Categories of personal data we collect

We collect only what we need to run our business with you.

  • Identifiers & contact: name, email address, phone number, mailing/business address.
  • Business & authority info: company name, USDOT number, MC number, carrier name shown on your truck, insurance details.
  • Banking & payment info: ACH routing and account numbers, name on account, and account type. These are encrypted at rest with AES-256-GCM.
  • Government / tax identifiers: the information on your W-9 (name, business name, TIN/SSN or EIN, address, signature). Stored in a private, access-controlled bucket.
  • Documents you upload: signed subcontractor agreement, voided check or ACH form, W-9, and any additional documents you send us.
  • Technical / usage data: IP address, browser type, pages visited, timestamps, and basic device information collected through server logs when you use the site.

Sensitive data

The banking numbers and tax identifiers above are treated as sensitive. We collect them because they are required to pay you and to comply with IRS rules; we do not process sensitive data for any other purpose without your consent.

How we get this data

We receive it directly from you when you register, upload documents, or contact us. We do not buy personal data from data brokers.

How we use your data

We use your personal data to:

  • Onboard you as a subcontractor and set up your account.
  • Send you a verification code so you can sign in securely.
  • Pay you via ACH and issue tax documents (1099s) as required.
  • Communicate with you about dispatch, payments, and legal notices.
  • Comply with legal, tax, insurance, and regulatory obligations.
  • Secure and maintain the site (fraud prevention, error logging, backups).

Who we share your data with

We do not sell your personal data. We share it only with the service providers we need to operate:

  • Cloud hosting & database: our infrastructure provider stores your account and profile data on our behalf.
  • Email delivery: used to send you verification codes and transactional messages.
  • Bank / payment processing: our bank uses your ACH information to send payments.
  • Tax and legal advisors: used only when required to comply with the law.
  • Government agencies: when required by subpoena, court order, or applicable law.

Each service provider is bound by contract to use your data only for the services they provide us and to protect it appropriately.

No sale, no targeted ads, no profiling

TREC Trucking LLC does not sell your personal data for money or other valuable consideration, does not use it for targeted advertising, and does not use it for profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

How long we keep it

We keep your account and business records as long as you have a working relationship with us, plus the period we are legally required to keep tax and financial records (generally at least 7 years for IRS purposes). Uploaded documents (W-9, agreement, voided check) are kept for the same period. Verification codes are deleted or invalidated 10 minutes after issue. Server access logs are kept for a short operational window.

How we protect it

We use industry-standard measures: TLS in transit, encryption at rest for banking numbers (AES-256-GCM), a private storage bucket for uploaded documents, row-level security so each user can only read their own data, and access controls for staff. No system is perfectly secure, but we work to keep your data safe.

Children

Our services are directed to businesses and adult owner-operators. We do not knowingly collect personal information from children under 13.

Your rights under Texas law (TDPSA)

If you are a Texas resident, you have the right to:

  • Confirm whether we process your personal data and access that data.
  • Correct inaccuracies in the personal data we hold about you.
  • Delete personal data provided by or obtained about you.
  • Obtain a portable copy of the personal data you gave us.
  • Opt out of the processing of your personal data for the sale of that data, targeted advertising, or profiling that produces legal or similarly significant effects (we do not engage in these, but you can still ask us to confirm and opt you out).

How to submit a request

Submit a request through our secure form or by email. We will respond within 45 days as required by TDPSA § 541.055 (extendable once by 45 days when reasonably necessary, with notice).

How we verify you

To protect your data we may need to verify your identity before acting on a request — usually by matching information you provide against information already on file (email, phone, DOT number, business name).

Right to appeal

If we decline to act on your request, we will explain why within 45 days. You may then appeal within a reasonable time; we will respond in writing within 60 days. If we deny your appeal, you may submit a complaint to the Texas Attorney General.

Changes to this policy

We may update this Privacy Policy from time to time. When we do we will update the effective date above. Significant changes will be highlighted on this page.
